Recording and Filing
|
Some papers filed with the county clerk are "filed for recording." Other papers filed with the county clerk are simply filed and not recorded.
The papers that are filed for recording are generally known as "instruments." The papers that are simply filed and not recorded are generally referred to as "court documents."
The "instruments" that are filed for recording are generally public records such as deeds, liens and judgments. The "court documents" that are simply filed and not recorded are generally the judicial records of the various courts.

Certified Copies
The county clerk is often called upon to provide a certified copy (also known as an "attested copy") of an instrument. These certified copies are often used to prove ownership of property, personal identity, and other important matters. The clerk, by affixing his or her seal and signature, swears that the copy is a true and exact replica of the recorded instrument in its entirety.
